These are Cirkulær Outdoor's general terms for the submission of goods for consignment sale. Before submitting goods to Cirkulær Outdoor, you must accept the general terms.
Consignment Sale
Cirkulær sells goods on consignment with a 40% split. This means we retain 60% of the sales price on all items we sell on your behalf. Cirkulær reserves the right to refuse items that we believe do not fit our concept.
You agree that we set the price of the items at the price we deem appropriate. We reserve the right to change the price by 20% during the sales period without notifying you. We do this to facilitate the sale of the item as quickly as possible at the most accurate price possible.
Our sales period is from June 1 to September 1. During the sales period, it is not possible to retrieve submitted items. After the sales period, you will have seven (7) days to retrieve or claim items that have not been sold. If an item is not sold and remains unclaimed seven (7) days after the end of the sales period, ownership of the item transfers to Cirkulær. Cirkulær is then free to dispose of the item.
The consignment customer retains ownership of a submitted item until Cirkulær sells the item to a customer or Cirkulær chooses to buy out the item from the consignment customer. The consignment customer’s sales commission remains the same regardless of whether the item is purchased by a customer or by Cirkulær.
Becoming a Consignment Customer
To become a consignment customer, you must confirm that you meet the following requirements:

Be at least 18 years old

Have a Norwegian personal number

Have a Norwegian bank account in your own name, which is required to pay out the sales commission

Provide your own contact details

Be the legal and rightful owner of the items submitted to Cirkulær and have the right to submit them for sale through us

Ensure that the items submitted comply with our quality criteria for submitted items (Read more about quality criteria in the Quality Criteria section)

Continuously update contact information to ensure it is always correct and that inquiries from Cirkulær can be received
Payment of Sales Commission
The sales commission is registered in the customer account and updated on My Page. The balance can be used to shop at Cirkulær or paid out to the consignment customer.
Payment of the sales commission is not automatic and must be initiated by the consignment customer by contacting Cirkulær via the payment request form. The available payment methods and options may vary over time.
Cirkulær charges a fee of fifty kroner (NOK 50) for each payout to cover our administrative costs for the payment.
Outstanding sales commission can be claimed within 12 months from the submission date. After that, the consignment customer’s sales commission will revert to Cirkulær, and the consignment customer can no longer claim or request the sales commission to be paid out.
Quality Criteria for Submitted Items
Cirkulær accepts items that fit within the framework of our concept and that we believe can be sold during the sales period. When determining which items to accept, we base our decision on our quality criteria for submitted items. They are:

We accept outerwear, clothing, shoes, and accessories.

We only accept clothing that is modern and in good condition at the time of submission.

The items must be freshly washed, intact, and free from pests such as moths or pet hair. The items must otherwise be in good condition.

Shoes must be cleaned before being submitted.

We do not accept underwear, workout clothes, swimwear, homemade or self-sewn clothes.

We do not accept items intended exclusively for children.

We do not accept clothing that is wholly or partially made of real fur.

We do not accept any form of counterfeit goods or items that otherwise infringe on a third party’s trademark or other intellectual property rights. If the consignment customer submits an item from an exclusive brand, we may require proof of authenticity, such as a receipt or bank statement.

We do not accept items that we value at a sales price of over NOK 10,000 at Cirkulær.
We inspect items based on these criteria at the time of submission. If, after an item has been accepted for sale, it turns out that the item does not meet the quality criteria, we will contact the consignment customer and inform them of the discrepancy we have found. The consignment customer can then choose to retrieve the item or let Cirkulær donate it to charity. In these cases, if the consignment customer wishes to retrieve the item, they must pick it up from the store within 7 days. Otherwise, Cirkulær will donate the item to charity.
Responsibility
The customer is responsible for and shall compensate Cirkulær for any damages and costs incurred by Cirkulær as a result of the customer breaching the agreement.
Cirkulær is not responsible for any damages and inconveniences that arise:

In the customer’s business operations

Due to circumstances specified in the terms that we do not take responsibility for

Due to a customer not fulfilling their obligations under the terms

On the customer’s own property due to items purchased from us, for example, due to pests transferred from an item to the customer’s property.
Cirkulær’s maximum liability to customers for any losses and damages incurred is limited to:

Losses and damages occurring in connection with the purchase of goods: the total amount of the customer’s purchase

Losses and damages occurring in connection with the submission of goods for sale: the value of the submitted item (customer’s commission), according to the price set by Cirkulær for the item.
